Terms of Service

These Terms of Service ("Terms") govern your use of the hosting, reseller, domain and related services provided by OrienHost ("OrienHost", "we", "us"). By creating an account, placing an order or using any of our services, you agree to these Terms, to our Acceptable Use Policy, our Privacy Policy, our Cookie Policy and our Refund Policy, which form part of these Terms.

We support privacy and free expression. That does not make our network a place without rules: these Terms exist to keep the service lawful, stable and fair for every customer.

1. Definitions

  • Service: any product we provide, including web hosting, WordPress hosting, WHM reseller hosting, domain registration and add-ons.
  • Customer or you: the person or organisation that holds the account and orders a Service.
  • Client Area: our customer panel where you manage services, invoices and support tickets.
  • Content: all files, data, software, email and other material you store or transmit through a Service.

2. Eligibility and your account

  • You must be at least 18 years old and legally able to enter into a contract.
  • To open an account we require your first name, last name and a working email address. Other fields are optional. You are responsible for keeping this information accurate, because we use the email address for invoices, security notices and abuse reports.
  • You are responsible for all activity under your account and for keeping your passwords, passkeys and login codes secret. Tell us immediately if you suspect unauthorised access.
  • You may sign in with an email code, a passkey or a third-party login such as Google. If you use a third-party login, that provider's terms also apply.

3. The hosting services

  • Shared resources. Our hosting plans run on shared servers managed with cPanel/WHM, CloudLinux and LiteSpeed Web Server. CPU, RAM, disk I/O, IOPS, entry processes, processes and inodes are per-account limits enforced by CloudLinux. They are maximums on a shared server, not dedicated hardware.
  • Plan limits. Each plan's disk space, monthly traffic, number of websites, email accounts, databases and other limits are shown on the order page and in the Client Area. When an account reaches a limit, its processes may be slowed down or new processes may be refused. If an account repeatedly exceeds its limits, we may ask you to optimise your site or move to a larger plan.
  • Reseller plans. Reseller accounts receive WHM access limited to their own cPanel accounts. Server administration, root access and access to other customers are never included.
  • Backups. We take backups of hosting accounts twice a week and keep a limited number of copies. Backups exist to help us recover from failures; they are not a guaranteed archive. You are responsible for keeping your own up-to-date copies of your Content.
  • Software. You are responsible for keeping the applications you install (for example WordPress, plugins and themes) updated and secure.

4. Orders, billing and renewals

  • All prices are in US dollars (USD). Taxes are added where they apply.
  • Services can be billed monthly or for 3, 6 or 12 months. Longer terms include the discount shown at the time of order (currently 5%, 10% and 15%).
  • Services renew automatically for the same billing term at the price of that term, unless you cancel before the renewal date. The renewal price is shown on the plan and in your Client Area.
  • Renewal invoices are issued before the due date. If an invoice remains unpaid after its due date, the Service may be suspended; if it remains unpaid after a further grace period, the Service may be terminated and its data deleted.
  • If we change the price of a plan, the new price applies to new orders. For existing services we will notify you before a new renewal price takes effect.
  • Promotional prices apply only to the period and conditions stated in the promotion.

5. Payments

  • We accept payment in cryptocurrency through our payment provider and from your account balance. The payment methods available are shown at checkout.
  • Cryptocurrency payments are credited once the payment provider confirms the transaction. Network and miner fees are paid by you. If you send less than the invoice amount, the invoice stays partly unpaid until the difference is paid.
  • Payments are handled under our Refund Policy.

6. Your responsibilities

  • You are responsible for your Content and for making sure that your use of the Service is lawful in every jurisdiction that applies to you and your visitors.
  • You must follow our Acceptable Use Policy.
  • You must not attempt to access other customers' data, our servers' administrative functions or any system you are not authorised to use.
  • Resellers are responsible for their own clients, for passing on terms that are at least as strict as ours, and for acting on abuse reports concerning their clients.

7. Abuse reports

We review abuse reports individually. Unless a report concerns a zero-tolerance category listed in the Acceptable Use Policy, we normally forward it to you and give you a chance to respond or fix the issue before we act. We do not inspect your Content as a matter of routine; we only access it when necessary for support you have requested, for security, for handling a credible abuse report or where we are legally required to.

8. Availability and maintenance

  • We work to keep the Services available, but we do not guarantee uninterrupted or error-free operation, and we do not offer a fixed uptime percentage.
  • Planned maintenance is announced in advance where possible. Emergency maintenance may be carried out without notice to protect the service.
  • Compensation for extended outages is described in our Refund Policy.

9. Suspension and termination

  • You can cancel a Service at any time from the Client Area. Unless stated otherwise, the Service remains active until the end of the paid period.
  • We may suspend or terminate a Service if you breach these Terms or the Acceptable Use Policy, if an invoice is not paid, if your account endangers the security or stability of our systems, or if we are legally required to.
  • For zero-tolerance violations, or where there is an immediate risk to our network or other customers, we may act without prior notice. In other cases we will try to contact you first.
  • After termination we may delete the account and its Content, including any backups, without further notice. Download your data before cancelling.

10. Limitation of liability

  • The Services are provided "as is" and "as available".
  • To the extent permitted by law, we are not liable for indirect or consequential damages, lost profits, lost revenue or lost data.
  • Our total liability for any claim relating to a Service is limited to the amount you paid for that Service in the three months before the event that caused the claim.

11. Indemnity

You agree to compensate OrienHost for claims, losses and costs (including reasonable legal costs) that arise from your Content, from your breach of these Terms or from the activities of your reseller clients.

12. Changes to these Terms

We may update these Terms. We will publish the new version on this page with a new effective date and notify customers of significant changes by email or in the Client Area. If you continue to use the Services after the changes take effect, you accept the updated Terms.

13. Governing law and disputes

We will try to resolve any dispute with you informally first; please contact us through a support ticket. If a dispute cannot be resolved this way, it is subject to the law of the place where OrienHost is registered and to the courts competent there, unless mandatory law gives you other rights.
